Active Warrant Search in Carroll County

An arrest warrant permits law enforcement to arrest and detain the individual so named in the warrant. District Court Commissioners and other officers of the local judicial branch are responsible for warrant issuance. How to Get an Arrest Record Expunged in Carroll County

Carroll County residents may get their arrest records removed from public view through expungement or shielding. Expungement erases a record completely. Meanwhile, shielding makes it inaccessible to public record requests, while still keeping the information on official databases. 

According to Md. Code, Crim. Proc. § 10-103.1, arrest records in a non-prosecuted case are automatically shielded for three years, then completely expunged from official systems. The individual does not need to do anything, although they may apply for an expedited expungement. 

Similarly, in cases that do not result in a conviction, defendants can have their records sealed three years after the case is settled, per Md. Code, Crim. Proc. § 10-105. However, this process is not automatic. 

For arrests that resulted in a sentencing, individuals can petition the relevant court, provided they were sentenced for an eligible offense. Md. Code, Crim. Proc. § 10-110 sets different waiting times for different categories of offenses. In general, the more serious the offense, the longer the wait before the defendant can petition for record relief. 

Certain records that cannot be expunged can still be shielded under Md. Code, Crim. Proc. § 10-301. This privilege applies to only 12 specific misdemeanors and can be used only once in an individual's life. Anyone whose conviction meets these criteria may file a petition three years after completing their sentence. 

Whether expungement or shielding, the petitioner can obtain and file the applicable form at the clerk of the relevant court. After 30 days without objection from the public or a government agency, the judge may issue a formal order instructing the record custodian(s) to apply the appropriate record relief.
